This Privacy Policy of “www.macksearplugs.com” has been posted and is effective as of  March 19, 2010. At McKeon Products, Inc. (“McKeon”) your privacy is important and we are committed to protecting your personal data. As used in this Privacy Policy (this “Policy”), the term “personal data” means data such as: your name, mailing address, e-mail address, Internet service provider, telephone number, or other personally identifiable information that may be supplied by you or collected about you according to applicable local legislation. We hope that this Policy helps you understand what kind of personal data, if any, we collect at this site and how we handle and use any such personal data after collection.

This Policy is applicable to this McKeon’s general informational web/mobile sites. All McKeon sites to which this Policy is applicable are collectively referred to as this ”site.” Note that special use terms, or site- or page-specific terms (referred to as “special terms”), may apply to certain pages/services, but the applicability of any such special terms will be expressly indicated.  In the event of any inconsistency between any special terms and this Policy, the applicable special terms will prevail over the terms of this Policy.

McKeon may from time to time change this Policy or change, modify or withdraw access to this site at any time with or without notice. However, if this Policy is changed in a material, adverse way, McKeon will post a notice advising of such change at the beginning of this Policy and on this site’s home page for 30 days. You expressly understand, accept, and give your consent that any of your personal data obtained in connection with your use of this site may be transferred to any person, if permitted by applicable local legislation, whether across international borders to server locations supporting this site (including but not limited to transfers from those locations back to the country of your location) for operating and developing this site and McKeon services or otherwise, including but not limited to transfers to McKeon subcontractors or agents, as mentioned below, who perform tasks related to this site, or McKeon services, or for the purposes of storing the data in relevant databases, which may be located in any country where McKeon has operations.  If you place an order for a product, request a service, register for a user account or submit content to this site, we may need to contact you for additional information required to process or fulfill your order, account and/or request. Any information you provide in response thereto shall be “personal data” for the purpose of this Policy.

Unless compelled by applicable law or administrative or judicial order, we will not provide personal data to a third party without your permission, except as necessary to process your order, fulfill your requests, manage interactive customer programs, enforce our Site Terms, or where we believe disclosure is necessary to limit our legal liability or to protect or enforce the rights, interests or safety of the site, our users or others. Because McKeon is committed to protecting your privacy, McKeon does not engage in the practice of selling or trading personal data to other companies for promotional purposes.

Visitor Identification – Usage of “Cookies”
From time to time, information may be placed on your computer to improve this site and McKeon services for you. This information is commonly referred to as a ”cookie.” Cookies are pieces of data stored on your computer’s hard drive or browser, and not on this site. Minors
The site is not intended for children under 18 years of age. McKeon does not knowingly collect personal data from children under 18.

Miscellaneous
(i) Governing Law. This Agreement shall be governed by and construed in accordance with the laws of the State of Michigan, without regard to its principles of conflicts of law. You agree to exclusive jurisdiction of the federal and state courts located in the Eastern District of Michigan for any litigation or dispute arising out of or relating to these Terms or the Services or the Site, and, to the maximum extent permitted by law, waive every defense based upon improper venue, inconvenient venue or lack of jurisdiction. (ii) Severability. If any provision of this Agreement is held by a court of competent jurisdiction to be contrary to law, then such provision shall be construed, as nearly as possible, to reflect the intentions of the parties with the other provisions remaining in full force and effect. (iii) Waiver. McKeon’s failure to exercise or enforce any right or provision of this Agreement shall not constitute a waiver of such right or provision in the past or future unless acknowledged and agreed to by McKeon in writing. (iv) Titles. Any heading, caption or section title contained in this Agreement is inserted only as a matter of convenience and in no way defines or explains any section or provision hereof. (v) Assignment. This Agreement may be assigned in whole or in part by McKeon to an affiliate or successor. This Agreement may not be assigned in any manner by you without the express, prior written permission of McKeon and any such assignment or attempted assignment will be null and void. (vi) Entire Agreement. Except for any written agreement separately executed between us and relating to these Terms or the subject matter of this Agreement, this is the entire Agreement between us relating to these Terms and the subject matter herein and supersedes and any all prior or contemporaneous written or oral representations, warranties, communications or agreements between us.

You may assign your rights under this Policy only with the express written permission of McKeon.
